How to Check if a Car Has Outstanding Finance
Buying a used car with outstanding finance can create significant complications. The consequences depend on the finance agreement and the circumstances of the sale.
The danger of outstanding finance
With some agreements, such as Hire Purchase (HP) or Personal Contract Purchase (PCP), the finance provider may retain legal title until the agreement is settled. The precise position depends on the agreement and any steps taken to settle or transfer it.
If you are considering a car that may have finance outstanding, confirm the position with the finance provider and obtain appropriate settlement evidence before proceeding.
How do you check for outstanding finance?
A V5C logbook or visual inspection does not establish whether finance is outstanding. A Full Vehicle History Check may report finance markers where information is available, but coverage and update timing can vary.
Ask the seller for relevant settlement details and verify the agreement directly with the finance provider before relying on a check result.
What if the check flags outstanding finance?
If a check reveals outstanding finance, do not hand over any money. You have a few options:
- Walk away: The safest and easiest option.
- Ask the seller to clear it: The seller can contact their finance company, pay off the settlement figure, and provide you with written confirmation that the debt is cleared. You should run another check to verify this before buying.
- Pay the finance company directly: If you really want the car, you can pay the outstanding finance settlement figure directly to the finance company, and pay the remaining balance to the seller. Never trust the seller to "pay it off tomorrow" with the cash you just handed them.
